Governing law and jurisdiction

This Agreement will be governed by the laws of England and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

Inspection Services

The inspector will advise the client by means of a written report as to his or her experienced opinion of the visible standard of condition of the property at the time of inspection. (No guarantee can be given or offered after this date as others may have access to the property post inspection)

Photos may be taken on site by the inspector, but will not be used without prior consent of the home owner.

Any areas not inspected for any reason will be identified within the report , these may be , but are not limited to areas such as TV or telecoms which are not available or connected at the time of connection (please refer/add link to page where this is covered)

Content

The inspector will report upon the main aspects of the property to the NHBC standard, referring to individual warranty technical standards where applicable/necessary, building regulations and on occasion making recommendations for improvement

Holme Snaggers will aim to deliver the report via email within 72 hours of the inspection date, in normal circumstances, and during working weekdays only ( excludes weekends and public holidays, reports will only be posted out to clients by prior arrangement ).

Fee Payment

The client will pay the advertised fee, including VAT prior to the inspection date, or by agreement with NBI , prior to issue of the snagging report.

Where Holme Snaggers are unable to gain entry, refused entry by the site or is asked to leave the premises at any point during the inspection, 50% of the Inspection fee will be due (to recover some of our costs). We will always confirm access arrangements, where we fail to ensure access arrangements, there will be no costs to the client as a result.

Fee Payment (Cancellation policy)

Should clients wish to cancel the inspection they can do so at any time, for any reason, there is no cancellation fee so long as the client has confirmed the cancellation with 24 hours notice.

 

Limitations of Liability

  • To the extent that the website and the information and services on the website are provided free-of-charge, we will not be liable for any loss or damage of any nature;

  • We will not be liable for any consequential, indirect or special loss or damage;

  • We will not be liable for any loss of profit, income, revenue, anticipated savings, contracts, business, goodwill, reputation, data, or information;

  • We will not be liable for any loss or damage arising out of any event or events beyond our reasonable control;

  • Our maximum liability in relation to any event or series of related events will be limited to as reasonable amount.

Nothing in these terms of use (or elsewhere on our website) will exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law. Subject to this, our liability to you in relation to the use of our website or under or in connection with these terms of use, whether in contract, tort (including negligence) or otherwise, will be limited as follows:

Breaches of these terms of use Without prejudice to our other rights under these terms of use, if you breach these terms of use in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
